$1 Billion Lawsuit- Nicole Gubin versus Ambit Energy

Direct-to-consumer energy retailer Ambit Energy LP was hit Monday with a lawsuit seeking more than $1 billion for allegedly defrauding and harassing an independent consultant it had signed up to recruit new customers. The suit, filed in Brooklyn federal court, accuses the Texas-based company of federal racketeering, fraud and unfair business practices. The plaintiffs, Nicole Gubin and her company, BH Seven LLC, also brought claims of libel, defamation and harassment.

Ambit buys electricity and natural gas at wholesale prices and resells it to customers recruited by a network of more than 60,000 independent agents such as Gubin. The company operates in New York, Texas and several other states with deregulated energy markets.

The lawsuit characterizes Ambit as operating as a pyramid scheme which makes false and misleading statements that constitute deceptive acts or practices. The suit also accuses Ambit's top executives of spreading false statements about Gubin's job performance, poaching her customers and discriminating against her for being Jewish and a woman.

The plaintiffs seek $600 million in compensatory damages, $250 million in punitive damages, $250 million in liquidated damages and $13 million in attorneys' fees and costs. They also requested a permanent injunction enjoining Ambit from doing business in New York.

A representative for Ambit, Robin Stevens, said the company had not had a chance to review the allegations made by Gubin, who is still listed as one of the company's active consultants.But Stevens added that the company has done nothing to defame, defraud or otherwise damage Ms. Gubin, and we are confident these allegations as stated will be shown to be groundless and without merit.

According to the complaint, the company unfairly accused Gubin of violating its policies and procedures and blocked her from operating a website on which she signed up new Ambit customers. She also alleged Ambit attempted to sign up new customers on its own, siphoning off her potential recruits, and withheld monthly payments and bonuses.

The case is Nicole Gubin and BH Seven LLC v. Ambit Energy LP et al., in the U.S. District Court for the Eastern District of the State of New York, no. 11-2483.

  2. I am shock to see such allegations brought against a fine company, Ambit Energy, As a former consultant myself, I find this news
    of a lawsuit against Ambit Energy as a joke. You joking right? I hope you and Ambit get this solved so you can move on. Personnally myself, my only thing with Ambit Energy is that they were not moving fast enought from State to State offering their energy services. But, this is a fine company with much intrgrety. Something wrong somewhere; Why a lawsuit?

    With so much against the MLM industry, we don’t need this kind of action or lawsuit unless it is really cause for. Even though I have moved on to another business opportunity, I hope this lawsuit does’nt hurt the industry.

  3. You get paid what you are worth in network marketing so discrimination is impossible because to a large degree in this technology age you are a faceless raceless number until you are identified by your success. Discrimination at that point is counterproductive to the company.

    I am saddened to see that Ms Gubin CHOOSES to react by making herself a victim.
    She has also exposed herself to possible future lawsuits from both Ambit Energy And/Or existing consultants as a class-action.
    Ambit has an EXCELLENT reputation in the industry. I ALWAYS get paid by Ambit ON TIME and as expected and mutually agreed.

    Then again, I ALWAYS stay within the scope of Ambit’s Written Policies and Terms of consultancy. I know first-hand of many so-called “leaders” who take short-cuts, and have operated in a questionable manner- and they seem to also be the loudest “complainers”, especially when “the rules” and “integrity” catch up to them, You can only abuse the system for so long, until loopsholes are closed.

    If she does not win this case ( I doubt she will- she cannot prove over $1B in damages ), then she has caused the smearing of the good reputation of Ambit Energy.

    This event causes damage to every existing Ambit agent, ESPECIALLY those on MS Gubins team.
    Leaders need to LEAD BY EXAMPLE and the Leadership example by Ms Gubin is not consistant with growth and personal development. I suspect she expects an out-of-court payday. Let me go spill some hot Coffee on myself so that I can sue…….

  8. Hey Uri, if your case is so strong why don’t you give us some specific instances where Ambit has wronged you instead of making broad, sweeping accusations that can not be refuted? Although, “Be prepared” sounded very ominous. I think I was scared for a second!

    Please read the Ambit?s Written Policies and Terms of consultancy.

    YOU THEN MUST REPORT IT TO AMBIT Asap or YOU WILL BE TERMIANTED YOURSELF for NOT reporting it.

    Ms. Gubin is known to me PERSONALLY. Many other consultants who have joined her efforts and some that will be joing soon HAVE BEEN under-paid.
    Believe it or not, Ambit has been taking money (i.e under-paying ) out of MAJORITY of monthly residual income paychecks.

    The lawsuit will DEFEND ALL(!) consultants.

    I always report known blatant disregard of the terms.
    Some of these practices were exposed after the loop holes were closed and the involved people complained, but certainly they were exploiting the loophole, and Corporate was aware.
    Ms Gubin is also known to me personally. I am well aware of her ‘style’. I respect what she can accomplish. In speaking to others who are and have been on her team, I am grateful that I am not on her team.
    I do believe,however, that she did not exhaust effort or method of addressing her issue, before now putting Ambit and every other consultant through the impact it may have on gathering future consultants. I believe it was an impulsive act, and not intellegently thought out. but – thats my opinion, and others will have thiers & I respect that.

  11. What a JOKE, I read her comments about how great Ambit is in 2007 and how the company changes lives ( IT DOES) for the better. Then after a couple of years of telling all the consultants in her origination how great Ambit is. And you too can be succesful. Then file a law suit that she has been wronged. I just have to wonder who (what company lobbyist ) did she get paid alot of money from to make such alligations.

    Because otherwise, I am afraid that you likely do not have time to grow your Ambit business as there are SO many blatant violations of basic Rules and Policies and Procedures and Compensation Plan all over Ambit consultant network (i.e. Brian McClure and below, if you know who/what i mean).
    I respect Brian and I am not aware about him(!) doing personally anything wrong whatsoever (as of yet).
    However, I expect the court hearing easily reveal that. You never know these days…

    What I am trying to point out is that the allegations that Ms.Gubin is making, in my opinon, are very serious.
    I hope and the chances are that the judge in this case will agree with me (and herself) on that.

    In talking with someone knowledgeable about the matter who has/is going to be a part of the lawsuit on Ms. Gubin’s side, I can derive that Ms. Gubin has strong evidences, at least on some of her allegations that I was able to review. ambit will NOT be able to overturn them.

    Do not forget about strange departures of KEY (mind the upper case) Ambit Executives (not only Scott Lawrence which is in itself a no less than a Shocking revellation) that all started EARLY 2010 and are still ongoing.

    Those people are holding the keys to the Pandora box.

    NOT EVERYTHING is WELL with Ambit.
    Chris Chambless knows that, not sure Jere Sr. ( not Jere JR.) does.

    Carlos is a legend and was a face of Ambit in 2007 and 2008!!!

    He was a bright, experienced (even seasoned), enthusiastic guy who stopped responding to calls and emails at the end of 2010.

So just curious Chris, since you SEEM to know quite a bit; when you become an Executive Consultant you have to sign a non-compete contract and If you then in turn violate that contract by lets say . . um I don’t know . . joining a MLM that offers natural gas (I think that falls into the catagory of a similar business) is it not the right of the company to enforce the contract?

    are discovered to have used names and social security numbers of
    unknowing individuals to build their organizations so quickly.

    Once the names in their massive downlines have been investigated
    and it is discovered that so many never heard of ambit watch how
    quickly the cases and comments cease and desist.

    This guy had thousands of consultants in Brooklyn yet you would
    see only a few individuals at the meetings week after month after year.

    I guess they all signed on helped him earn $300,000 last year and had
    no desire to earn anything for themselves.

    individuals with $400 who see an opportunity to earn
    millions monthly.

    I hope Ambit investigates downlines of these fast moving
    Executives, defends their great name, prosecute any and
    all offending parties to the full extent of the law and continue

    I regret that the Thompson family had to be exposed to the

    I DO seem to know quite a bit.
    I know that majority (probably, None) of Executive Consultants signed anything, regardless of how mediocre ( educationally, emotially, ethically, professionally) some(!) Ambit ECs are…
    Yes, some of Ambit ECs are part of law enforcement agencies (not only police) and some of them are convicted criminals…
    They call it divercity and Opportunity like NO other over there.
    Weel, people make mistakes in life….I am talking about building law enforcement careers here….:-)
    Still…It was well-known that Ambit was pushing it once, but this was not a part of Ambit Policies and Procedures.
    Therefore, it is(!) not required and un-lawful. It is the right of Ambit to enforce a contract, if there is one…but there is none.
    Still, I know where you are going: some sort of competition is not what Ambit should tolerate….IF AMBIT can prove it.
    INNOCENT until proved Guilty.
    That is what Gubin is suing Ambit for.
    BTW: Joining an MLM that offers natural gas is NOT a competition with Ambit in Maryland, or NJ or CA or GA or CT for example…
    Joining is One thing, and working in it is another. Right?

  19. Chris, you seem like a jilted lover? Since you’ve found another opportunity after Ambit why not pursue it? At the very least if you are bent on offending someone do the right thing and name names? As Shakespeare said “a rose by any other name would still smell as sweet.” I think you might also consider this much older phrase “let he who is without sin cast the first stone.” MLMs are hurt by this type of activity and it should be discouraged, get the billion over time not by a law suit.

They were not content to make money legally and with integrity, they had to push the envelope. This CS case should be thrown out immediately and these clowns should pay all legal fees.

    As far I everybody knows, they were investigated in the past, their web site was suspended during the investigation (i.e. they were DENIED access to the service that they were paying for), then everything was REVERTED and everything was REINSTATED. Nothing was proved, in the meanshile, they LOST business revenue and that is why they are suing. Sounds LEGAL and LEGITIMATE to me.

    I am not bent on offending anybody personally. I am stating FACTS, and the FACTS and not(!) me MIGHT be offending to someone.
    As my upline tells on videos and in person, many people chose(!) Ambit Energy to drive revenue to THEIR business.
    Poor, but, still(!) a choice in life that they made and will pay dearly for that in lost time and lost revenue.

    Almost all people make mistakes in life. Do you have a copy of the Ambit success magazine? Read it, you will see all the people there, I am serious.
    Many of them are portrayed as great leaders, yet they only have a handful (or two) of customers and a dozen (or less) of consultants. So sad…. Where all the success gone?!
    Why do you need names of ECs that are police officers, fire fighters and convicted criminals ( well, this is politely omitted from the magazine article)?

    The WHOLE Ambit opportunity is, UNFORTUNATELY, about EXAGERRATION and MISLEADING MISREPRESENTATION that is originated from Dallas,TX.
    I am desperately awaitng the show that they are going to put on again, this time for 7,000 dummies that will be paying for the Ambition ticket, airline, hotel accomodation and EVEN THEIR OWN lunch! What a misery !

The information I have is that the founders of Ambit are hiding their failed business experiences at Janglefish, Radius, Blue Vista and Spruce and now they are hiding the exit of their COO and architect of the Ambit marketing and compensation plan. The only fair thing to do is to let prospective Ambit reps have all the information about Ambit and their founders before they ask for their money. Why the deception?

  26. The big Ambit lie is that you can earn any real residual income in Ambit. Why is it a lie? Because Ambit has hidden qualification requirements that are set so high that the vast majority of people will never get paid no matter how big there dowline is. Ambit will get it but the field won’t. Yes, the big money is all illustrated in the Ambit presentation but the qualifications are not disclosed. It is blatently deceptive.

    For anyone that knows anything about MLM this is an old dirty trick that some companies use to make their presentation look good on the surface but they never have to pay out much to the field. The ugly truth is you can put anything in a presentation if you set the qualifications so outrageously high that hardly anyone will ever qualify to get paid. The result is that a few will always get qualified to be paid (or have qualifications waived by Ambit like the ex-Excel hired guns) but since the bar is set so high the vast majority will never get qualified to get paid and the foundation will begin to crumble soon for all. The unbelieveable truth is that the qualification requirements are still way to high even though they have already been lowerd once.

    For example, the Ambit presentation illustrates $151,090 residual income/month (sure) but they never mention that you must have 20 personal customers to be qualified to get paid. Look at all the qualifications to get paid and you will see that the average person will never qualify to earn more than a few hundred dollars in residual income. Even worse, the same presentation that illustrates $151,090/month shows everyone with only 10 customers which means nobody in the example is qualified to get paid that amount. This is beyond simple deception.

    Now I know some of you out there are simply Ambit shills, but if you are truely serious about getting paid for your efforts at Ambit then this information has to make you sit back and wonder about the future.

  27. As for the hired guns, the last meeting I went to did not give me the ****** to sell anything. Mr. Chambless and his so called team of experts needs to get with the program. I remember Mr. Lawrence in a meeting a while back as being the life of the party. He should lead the channel. Mr. Chambless needs to go! A big bore!

    The deception is that the words “all your deserved comissions” is missing in the quote (i.e. your quote). Holston, can you count without any prejudice that you were IN FACT, paid off of ALL of your customers on ALL of your 6 levels? You can not(!). Ask your SC and ask your EC to open up his Power Zone and WATCH, WATCH carefully…. You trust Jere and Chris on that. Pathertic…. Have you noticed that you CONSISTENTLY are NOT paid 100% off of all the customers on each of your levels month-after-month-after-month? How come? Because you were cheated of your comissions because you can not assure even yourself that you were paid all the money your earned off of these very 6 levels. Trust me. Take a calculator in hand, use your Power zone reports and double-cehcke Ambit. This is your money. Count how many customers you had one each of your levels and how much you were paid. Take 5th and 6th level. You wil lose sleep and appetite over this semingly litte issue.On a flip side, i see thatyou are an RC only. boy, how naive are you.   33. This guy Chris sounds like a spurred lover that forgot to wash the sand out of his vagina. Of course you don’t get paid on every customer that is showing active on your powerzone. There are several reasons why you wont get paid on energized customers (besides the DEEP,DARK SECRET of requiring 20 personally enrolled customers, which we make a mention of at every meeting I have ever attended or participated in): they are below your 6th level in your MC, they used under 500 KW, they are active but have not received their first bill, or they paid their bill late. Therefore, if you and your downline are continually gathering new customers month after month, you will consistently have customers that you are not getting paid on. Furthermore, if you are an RC, SC, or EC with a large organization that is adding 50 to 500 customers a month, you will not be paid residual income for at least 1 or 2 months after they switch. In addition, I hate to sound petty, but it does not surprise me that someone that can not figure out how to use spell check might have difficulty comprehending the compensation plan.

    11 Nov 2009 – A federal judge tossed out a lawsuit Monday that alleged Dallas electricity retailer Stream Energy is operating a pyramid scheme. In Houston, U.S. District Judge Kenneth Hoyt agreed with Stream; former sales representatives for the company are required by the contract they signed to settle disputes by arbitration rather than a lawsuit against Stream Energy.

    The Ex ? MLM reps argued Stream, an MLM Network-Marketing company, charges sales associate?s $329 to sell electricity, broke the law because Stream failed to produce goods or services in tangible goods or services. Stream energy argued that its strategy is legal and similar to Mary K, the skincare company.

    Scott Clearman, the Houston lawyer who filed the suit, was also seeking class-action status. These hopes were dashed when the judge ruled the sales associates had agreed when they signed their contract with Stream Energy Electrical to submit any complaints to arbitration. There is an open question if the sales associates will appeal the decision to the 5th U.S. Court of Appeals in New Orleans.

    Class Action Federal Lawsuit Against Stream Energy, Executives, Alleging Unlawful Pyramid Scheme

    2 July 2009 HOUSTON ? Attorneys from the Clearman Law Firm announced a federal class action lawsuit filed yesterday under the Racketeer Influenced Corrupt Organizations Act against Dallas-based Stream Gas & Electric, Ltd., Ignite Holdings, Ltd., their related companies and affiliated individuals.

    A retail electricity and gas provider in Texas and Georgia, Stream has grown in only three years to become the 29th largest private company in the Dallas/Fort Worth area based on revenues of more than $800 million in 2008. Stream?s marketing division, Ignite, has fueled Stream?s growth through what the company calls a ?multilevel marketing program.?

    The 89-page federal complaint alleges that Stream- Ignite?s multilevel marketing program is actually an unlawful pyramid scheme. Pyramid schemes are inherently doomed programs in which investors recruit people to pay money to those above them in a first-come-first-served hierarchy with the expectation that they will get payments from other investors who enter the program later. When the number of newly recruited investors eventually dwindles, the payment structure collapses.

    Specifically, the lawsuit filed in the U.S. District Court for the Southern District of Texas in Houston alleges that Stream and Ignite induced the plaintiffs and others to invest in the ?Ignite Services Program? at a cost of $329 and purchase an ?Ignite Homesite? web page for a charge of $29 per month. The lawsuit claims that a large portion of the $329 is paid to those higher in the pyramid.

    ?Some of the individuals at the top of the Stream and Ignite pyramid earn millions of dollars a year, while most of those that are now joining the scheme will likely never recover their investment,? says Scott Clearman of the Clearman Law Firm, lead counsel for the plaintiffs. ?Stream promises recruits that they can make vast sums of money, but the fact is that most will lose their money.?

    In addition to Stream and Ignite, individual defendants named in the complaint include Ignite founders Chris Domhoff, Rob Snyder and Pierre Koshakj [sic], as well as several Stream employees. Additional defendants include Donny Anderson, Steve Fisher, Randy Hedge, Logan Stout and Presley Swagerty, all of whom are near the top of the alleged pyramid.

    IGNITE ENERGY THE FIRST

    Ignite Energy started in the “Dallas Infomart” E. Ross Perot’s Crystal Palace. Great showcase job. Ignite Energy was the first electricity MLM and was hot in Texas after Excel telephone went broke. The Ignite Energy company picked up some Excel top leaders and MLM sales reps to jump start their new electricity company in Texas. The deregulation of Texas electricity allowed Excel distributors to jump out of phone service over to electric energy.

    Both of the last two companies have Ex Excel reps in their works. The sales pitch is not different from telephone in regards to the ease of selling electric energy. Electricity is something needs and uses and the billing systems are very similar. The sales pitch among Excel representatives used to be “get paid everytime someone picks up the phone” Now they say: ?Get paid everytime someone turns on the lights!? That is great!

    ZURVITA

    Amacore Group’s Zurvita is competing (also other products besides energy) with Ambit Energy and Ignite Energy. Some big money here – but often that causes problems as much as it helps. For energy they contracted with MXEnergy already in multiple deregulated states. Zurvita Energy can sell electric service in Texas, Georgia, Ohio, New York, New Jersey, Michigan, and Massachusetts. Texas and Massachusetts gives them more markets to build MLM dowlines in. Zurvita can also sell natural gas in states that are deregulated to switch between natural gas providers, but there is not much money in gas.

  38. Ambit energy is a SCAM. I signed up in November of 2010 and didnt actually receive anything from them until January 2011. At first I saved roughly $20 a month. It was too good to be true. July hit and all of a sudden I got billed for $175.25 (my bill was $65 each month prior). I called Ambit and they said “sorry we supply the gas but you have to talk to National Grid about this. So I called National Grid and noticed that they have not read our meter in a year. Mind you about a month before we got a letter from Ambit saying that they noticed that we are using more gas then they thought. My gas meter is in the house so there is no way anyone can read my meter without me letting them in the basement. So I gave my new reading to National Grid and they advised me to not pay and that they would mail me a revised bill because we used LESS gas than they estimated. We waited and 11 days later we got the new one. In 11 days Ambit energy charged us another $175.25 on top of the $175.25 they bill 11 days before. Mind you the first bill said balance due to company $364.68 and the revised bill says balance due in your favor $86.85. I called Ambit and no one can help or even explain why they are doing this (not even the supervisors). No one in Ambit gets back to you when they say they will and no one can help in my situation. All they tell me is to pay the $350.00 and they will compensate us when/if they find reason to refund any payment. I do not trust Ambit in the least they are a SCAM!!

Are you that dumb? What do you mean nobody told you? You are a bunch of the most ignorant people I’ve ever seen. The blame is on you! It’s a shame you chose to join this company. Your presence is dirtying it up like a foul smelling odor in an elevator. You’re really sick, Go back to your slavery jobs or other…please stop trying to drag down a good thing to your level; and if you can’t properly read your bill or properly get to the bottom of your issues before you pull the trigger, before you jump to outlandish ridiculous conclusions, before you file some stupid lawsuit, WHY DON’T YOU take a look in the mirror and learn that your egotistical self tragically will be your very own downfall sooner or later- not Ambit’s.

    It is so funny, how now you want to jump on the band wagon about how Ambit is a scam. YET, when I came into the business you had just made executive. To you AMBIT was your God. But because Jere and Chris will not allow you to use your own tactics in the organization you have built and allow it to be the URI show you now want to bash AMBIT. Such a hypocrite. In the end what you do in the dark will be brought out in the light. I am Hispanic and I am woman. Ambit has not discriminated against me. If you are spreading negative energy. Believe me it will get back to Chris and Jere and they will NOT stand for anyone trying to taint their name and the hard work that good people like myself and other great consultants have put into it. If you do not like AMBIT fine. Be on your way and find another way to make money. But do not bash a great company. Everyone knows who you are and what you are about. URI you are a joke and truly not respected by anyone in the company. Truly you did the damage to your self and no one else is responsible for it. Know that many have heard what you say and who you talk about. You never know who is watching and who knows who. Just do yourself the favor and stay where you are and leave AMBIT alone.

  41. We were customers for almost three years before becoming consultants earlier this month. We did a lot of research on Ambit prior to joining up. If we know what is in the compensatoin plan, then what is the excuse for an EC (Uri) not to understand it? There are standards, policies, and procedures in place for a reason – and to ignore them is to invite disciplinary action. It would be amusing to read about people like Chris and Uri along with the people who filed the lawsuit, if it wasn’t such a slap in the face to all the people who are building their organizations based on honesty and integrity, not scamming customers and consultants by stealing proprietary information and lining their pockets at others’ expense. There will always be people in any business who seek to cut corners, and then when they are caught yell Foul as loud as they can. Just like people who will run a red light because they can’t be bothered with the law! This will be interesting to follow as it plays out and the complainants need to testify on their unscrupulous activities. My concern is for those consultants who were not involved in this and how it will affect their efforts
