YTB Faces A Class Action
Embattled YTB International faces another legal challenge from a group of multi-state plaintiffs who filed a putative class action lawsuit against the company and its officers, charging the company is operating an illegal pyramid scheme.The plaintiffs, who are from Illinois, Missouri, Georgia and Utah, allege that Wood River, IL-based YTB International is a scam that offers no direct selling opportunity but instead is a never-ending recruitment scheme.

The complaint was filed June 10 in Madison County Illinois Circuit Court. The plaintiffs allege that the YTB program is based on selling cheap online travel agencies to recruits then encouraging them to recruit others while requiring certain levels of monthly services and, therefore, is a fraud.
In a nine-count complaint, the plaintiffs are seeking actual and punitive damages of more than $900,000, plus an order prohibiting the defendants from continuing in their conduct and other relief the court decides on.
YTB has faced legal challenges from the Attorneys General of California and Illinois as well as earlier class action lawsuits. YTB settled the California case while the action by the Illinois attorney general is pending. Other class actions filed against YTB by private plaintiffs were dismissed.

Direct Selling Secrets ARPU
Do you know the ARPU in your company or downline?
What is ARPU?
ARPU stands for Average Revenue Per User / Distributor usually abbreviated to ARPU and is a measure used by networking companies. It is the total revenue per year divided by the number of distributors or users.
This provides TOP Earners a granular view at a per user basis and allows it to track revenue sources and growth. Around $1,000 is a Direct Selling standard. Below $1,000 you might have a problem.
If a Direct Selling companies disclose it's distributor numbers it might be inflated, therefore you better can take a close look to the ARPU.

Forever Living Products claims to have 9,5 million distributors however if you look to the ARPU it is only $316 per user per year. Suppose you have a downline of 1,000 guys and girls your annual revenue over that group would be $316,000. On an average 5% payout you could qualify for, you will earn $15,800. Nice, but not very exiting…
So you better can look for a higher ARPU, if we sort the same figures on the highest ARPU, Amway is king with an ARPU of $2,800 per year. 1,000 distributors will bring you $140,000 commission… However, maybe it is easier to build up a Forever Living Products downline then an Amway downline, but that is an other discussion…..

Douglas Faggioli to step down as President and CEO
Michael Dean to become new President and CEO
15 March 2010 Nature’s Sunshine Products, Inc. (NASDAQ:NATR), a leading manufacturer and marketer of encapsulated herbs and vitamins, today reported financial operating results for the three and 12 month periods ended December 31, 2009.
The Company also announced that Doug Faggioli, after 27 years with Nature’s Sunshine Products, has decided to step down as President and CEO and as a member of the Board of Directors, effective June 30, 2010. Michael Dean, a member of the Board and a former ABC Cable Networks and Walt Disney Company executive, has been named to succeed him. Mr. Faggioli will remain as a consultant to the Company.
For the quarter ended December 31, 2009, the Company reported that net sales revenue totaled $89.9 million, compared to $88.2 million for the same three-month period in 2008, an increase of 1.9 percent. Operating income increased to $5.3 million, compared to an operating loss of $0.8 million for the same three-month period in 2008. Net income totaled $4.0 million, compared to a net loss of $0.5 million in the fourth quarter of last year. Basic and diluted net income per share was $0.26, compared to a net loss per share of $0.03 for the same period last year. These improvements in operating and net income were principally due to reduced operating expenses resulting from the favorable settlement of several value-added tax (“VAT”) and other non-income tax related contingencies, as well as management’s efforts to reduce selling, general and administrative expenses. Total operating expenses were $84.6 million, as compared to $89.0 million in the fourth quarter of 2008, a 4.9 percent improvement.
The Company’s balance sheet remained strong with cash and cash equivalents of $35.5 million, and shareholders’ equity of $57.1 million as of December 31, 2009. The Company has no long-term debt.
Net sales revenue for the year ended December 31, 2009 totaled $343.0 million, as compared to $373.2 million for the same period in 2008, a decline of approximately 8.1 percent. The decrease in sales was principally due to global economic conditions and the adverse effect of foreign currency fluctuations earlier in the year as a result of a stronger U.S. dollar. Excluding the effect of foreign currency fluctuations, sales in local currencies were down approximately 6.3 percent. Total operating expenses decreased to $332.3 million from $367.6 million in the prior year. Operating income increased to $10.8 million from $5.6 million year over year, primarily due to the reduction of operating expenses as a result of the favorable settlement of several VAT and other non-income tax related contingencies, as well as management’s efforts to reduce selling, general and administrative expenses. As a result, net income for the year increased to $6.1 million, or $0.39 per basic and diluted share, from a net loss of $1.8 million, $0.12 per basic and diluted share, for the prior year.
At year-end, active distributors totaled approximately 697,200, compared to 729,600 a year earlier, and active managers totaled approximately 28,800, compared to 25,900 at the end of 2008.

Amway parent grows to $8.4 billion in 2009
Strategic innovation, consumer focus fuel growth despite slow global economy; Alticor marks sales increase for ninth time in 10 years
ADA, Mich., (MARCH 9, 2010) /PRNewswire/ — Amway’s parent company, Alticor Inc., announced record sales of more than US$8.4 billion for the year ended Dec. 31, 2009, which was a 2.3 percent increase over 2008. Sales were negatively impacted by foreign currency fluctuations, which in local currency grew 5.9 percent.
“Our focus on using innovation to transform the Amway business is showing results,” said chairman Steve Van Andel. “The global economy challenged every business in 2009. Our continuing investment in products, technology, and connecting with consumers helped us weather the storm.”
Said president Doug DeVos: “Our distributors around the world deserve a lot of credit for persistence in a difficult economic climate. We put a lot of effort into improving our product offerings and building consumer awareness; the distributors put in the work to drive sales to our customers.”
The company also made gains in another key measure. Said Van Andel: “In 2009, we increased our market share in the direct selling industry, and continued to drive improvements and adjustments to our business that will help us, and our distributors, succeed over the long term.”
Strong regional sales in China, India, Southeast Asia, and Korea continued in 2009, while the 2008 relaunch of the Latin American market yielded a second year of more than 50% percent increase in volume in the region. Visible work has been done to strengthen and reposition Amway in established markets such as Australia, New Zealand, and South Africa, making the region one to watch for 2010.
In the North America market, continued transformation was marked by investments in visibility, training and consumer access. In November, the company launched an ordering “app” for Apple® iPhone, product information and sales support via podcast, and training apps on iTunes®. North America is also the first to implement a new web commerce platform, which will begin a global rollout later in 2010.

Tiens Biotech FY09 Profit Declines –
Nutrition supplement products maker Tiens Biotech Group USA, Inc. reported Monday a decline in profit for the full year ended December 31, 2009, reflecting a drop in revenues during the year.
For the full year, net income attributable to the Tianjin, China-based company decreased to
$23.84 million or $0.33 per share from
$27.66 million or $0.39 per share in the previous year.
Revenues for the year declined to $61.98 million from $77.25 million in the prior year.
Region-wise, revenues from China decreased to $27.24 million from $33.71 million a year earlier, partially due to a decline in domestic distributors' demand after stocking up on products in 2008.
International revenues were $34.73 million compared to $43.54 million a year ago. The company noted that the drop in international revenue was due to decreases in sales in the Asia-Pacific and Europe-Asia regions and also due to a general weakness in the global economy. Income from operations dropped to $25.8 million from $33.8 million in the preceding year. Gross profit margin for the year was 67.5%, compared to 67.8% in the previous year.
Jinyuan Li, chairman, president and chief executive officer said, "We remain confident that domestic sales will return to, and potentially exceed, previous levels, as distributors begin to replenish their stock of our products. In addition, we maintain this same positive sentiment regarding international sales, which we expect will benefit from the removal of export restrictions and gradual economic improvement."

YTB Shock: Anticipates $9.9 Million Loss
Ever controversial multilevel marketer YTB International anticipates a net loss of $9.9 million for the fiscal year 2009, compared to a net loss of $4.5 million for the prior year, the company told the Securities and Exchange Commission (SEC). YTB also said that it is unable to file its Annual Report (Form 10-K) for the fiscal year ending December 31, 2009 by the SEC deadline ”without unreasonable effort and expense.”
Headquartered in Wood River, IL, YTB said, based on the information available at this time, the net loss from discontinued operations for the year ending December 31, 2009 is expected to be $3.1 million compared to a net loss of $762,000 for 2008. Net revenues are anticipated to be $67.3 million in 2009 compared to $159.5 million reported in 2008.
YTB said the delay was caused by the resignation of John D. Clagg as CFO on February 2, 2010. YTB said it had been unable to complete all of the information requested by YTB’s independent auditors. YTB expects to file the Form 10-K no later than the 15th calendar day following the due date. Robert M. Van Patten, YTB’s CEO and interim CFO signed the filing.
In its SEC filing, YTB said total operating expenses for 2009 are currently $75 million compared to $162.8 million reported in 2008. Other items anticipated to have a significant impact on the net loss for 2009 include non-cash impairment charges for goodwill and intangible assets of $450,000 and $2.2 million, respectively, compared to $149,000 of goodwill impairment reported in 2008.
Also currently included in the net loss for 2009, are asset impairment charges of $4.5 million compared to $366,000 reported in the prior year period. The $4.5 million in asset impairment charges in 2009 relate primarily the $3.9 million write-down of YTB’s headquarters property. YTB intends to sell the property within the next 12 months. Inventory impairment charges are anticipated to be $724,000 for 2009 compared to $3.0 million reported in 2008, YTB said.

"After meeting Mr. Chris Greco, everything seemed to be too good to be true. The names he was tossing around and the prices he said he could deliver were just unbelievable. Let's face it a $10 a month unlimited talk and text plan, a $19.95 a month unlimited talk & text with 20 MB of DATA plan, were two unbelievable products that got us very excited, and we knew it would get our affiliates thrilled also. Marketer may cancel this Agreement at any time, and for any reason, upon written notice to iLG at its principal business address. iLG may cancel this Agreement for any reason upon 30 days advance written notice to the Marketer.”

- You will have been paid your regular commission for the February earning period on March 15th.
