Advocare Terminates 100,000 Distributors Leaves Network Marketing

MLM Attorney Kevin Thompson stated:

AdvoCare recently announced that it was doing away with its network marketing business model and instead shifting to a “direct to consumer” model. AdvoCare cites “confidential talks” with the FTC, saying that the FTC has taken issue with “how AdvoCare compensates its Distributors.”

Instead of taking their chances with litigation against the FTC, the owners have decided to completely bail out, going for the more certain outcome where they get to keep their profits instead of losing them to the government.

 

This all assumes that there’s a real threat from the FTC, which I’m not convinced that there was. I could be wrong, but something seems fishy.

With the exception of Herbalife, I’ve never heard of the FTC doing a confidential investigation. Usually they storm the gates, guns blazing. I know they have the ability for confidential investigations, I’ve just never personally seen one in our industry.

There’s part of me that wonders if AdvoCare initiated these talks with the FTC so they could “blame the government” as a pretext for these changes.

 

I’m probably wrong, but there’s just something off about the message below.

The regulatory landscape has not changed at all since 2016. In fact, it’s improved. The FTC has relaxed quite a bit since the election. AdvoCare was not led by fools. They seemed to have had a good in-house attorney, they had a healthy focus on product…by all indications, they were ok. This sudden shift, due to a “confidential discussion with the FTC” seems bizarre.

It’s worth mentioning that there’s not a single expression of gratitude to the field that built up their company to its heights today. They deserved better.

AdvoCare International announces a revision of its business model from multi-level marketing to a direct-to-consumer and single-level marketing compensation plan.

AdvoCare has been in confidential talks with the Federal Trade Commission about the AdvoCare business model and how AdvoCare compensates its Distributors. The planned change will impact Distributors who have participated in the multi-level aspect of the business. Those who currently sell only to customers will not be impacted and there will be no impact on Preferred Customers or retail customers’ ability to purchase products.

“Over the years, we have made many changes to the AdvoCare policies as the regulatory environment has shifted. Based on recent discussions, it became clear that this change is the only viable option,”

says Patrick Wright, AdvoCare’s Chief Executive Officer.

“Regardless of the model, we remain steadfastly committed to providing our high-quality nutritional products to our loyal customers who are seeking to live healthier lives. We stand behind the integrity and values of this company and will continue to work with our dedicated Distributors to provide the best customer service to ensure AdvoCare products are available for decades to come.”

The company gave notice to its more than 100,000 Distributors on May 17 that, effective July 17, 2019, AdvoCare will revise the business model to a single-level distribution model, paying compensation based solely on sales to direct customers.

The Retail and Preferred Customer programs will remain intact with discounts ranging from 20 – 40 percent. This new business model will allow the company to explore new and innovative ways to bring their premium products to market.

  2. As so many have said… sad for the people in the field that have worked hard to build this brand. Sad in many ways for the industry as a whole.
    I can remember the feeling when I was terminated from my corporate gig after 19 years with the same company. That’s when I decided that I never wanted to be in the situation where my whole income depended on a corporate job. Fell in love the the MLM concept and feeling grateful to have landed with a company that has stability and growth and really cares for the field. And it amazes me that our billionaire CEO greats me by name and with a big smile and hug when I see him at our global conference. I can’t imagine what that would feel like to basically have your business and income taken away from you.
    Yes it does sound pretty fishy.

      MLM is not a entrepreneurial opportunity. When your company CEO (your boss) has had enough…ITS END GAME!

      1. So, your comment indicates that it is still a job/ If MLM is not a legal and legit business model then why does it get all the benefits and write offs on their taxes as any other business. It is a similar contract when you open a franchise. There is a policies and procedures guideline there, that must be followed, including expensive franchise fees. So, is that also not a legit business model too?

        1. Paul, MLM is absolutely NOT a franchise. Franchise law is much more all encompassing and regulated than the MLM industry as you can clearly see given this example here. Policies and procedures by most MLM companies allow them to change their compensation plans (even for work already performed) at any time, as well as dismiss distributors and/or cut off their compensation at their own discretion. Read an actual franchise disclosure booklet (more like volume) and then compare it to the P and P of even major MLM companies. The first comment was right. You still work for someone, and they can still take away your job.

  3. What some of us how found out through the rumor mill is that the top distributorship was fraudulently recruiting in their down line for quite a while. Some in corporate new and turned a blind eye and it got reported to FTC and the hammer got dropped in those ‘secret meetings’.

      Do not give up there are other companies looking for employees .

  4. Look, the smartest thing for Advocare reps and their downlines to do is go to other like MLM’s and make a deal with them to move their whole team over. There are some amazing perks other companies will offer when this kind of thing happens and bottom line they aren’t going to make money by staying with Advocare. I do not rep any MLM but my friend was once the VP of sales for a large similar MLM. She got scooped up when her former MLM shut down. She brought over 200 distributors to the new company and they were all given quite a package. It’s really too bad and I just hate to hear anyone getting blindsided.

  6. Advocare uses Sucralose which has now been linked to leukemia. Woke people won’t use it. I think their products especially Spark taste like crap kool aid and are poison. So better to go and find another company.

  7. Sorry to hear, for all the reps involved. I have long abandoned the product part of the industry. I am crypto all the way people are literally making a fortune in these crypto programs. Everyone makes money. Nobody quits and we have found that people can create $200 to $500 daily income in 6 months or less. Of course there is no guarantee but I am seeing numbers like that routinely

I’m in the mood to engage… Are you saying ALL network marketing opportunities are a ‘scam’, and therefore every single person that is, has ever been, or ever will be involved with one is a vulture? 16M people at any given moment IN an MLM…? Are just the Advocare people exempt from this label for some reason or another?

        My 2 cents… the overwhelming majority of Advocare (and every other network marketing structured organization) are honest, honorable, and trustworthy people that are trying to improve their lives and those of their family, their colleagues, and their customers by providing a service and/or quality product that the believe (d) in enough to put not only their name and reputation, but the future of those they care for most on the line.

        I feel for them… Advocare seemed like a solid company. So does the one I’m with, and they aren’t even close to the track record that Advocare has/had. Gives one pause… for sure… but I am not dissuaded because you can’t build a $178B a year industry… 20X the size of the NFL… on smoke and mirrors. Rock stars will land on their feet…. either way. There are even better opps out there for serious entrepreneurs in ANY business. My own is FULL of big earners that dropped significant incomes that took years to build to take their current position… and their isn’t a regret among them. So… if I were an Advocare distributor… i’d stand back up, shake off the dust… and start thinking of the massive opportunity to switch horses in the middle of the stream… WITHOUT losing anything in the process… since that has already been taken away from them unilaterally by some govt and C suite decision-makers that came to an ‘understanding’ that involved sacrificing 100,000 loyal people’s residuals to save their own corporate futures.

        Opportunity is everywhere… if you’re a serious contender, you’ll find the right opportunity and end up making more than you were. Of those 100.000 distributors, 90% (industry average) are customers saving money on products they’d buy anyway at full price in CVS/Walgreen’s, were it possible. The other 10%? They just got their ‘free agency’ to walk away with their networks intact into a field full of more robust opportunities everywhere they look. They’ll find them.

        No WONDER so many are out there trying to get their attention… I’d take every single one I could get… after all, THEY WILL KNOW whether what I’m involved with looks like a winner or not. And even once-bitten, twice-shy… you can still make more money jumping into something experiencing explosive growth than you can licking wounds.

I agree with you on on pretty much everything you said, though I agree with those who are frowning on the predatory nature of those pouncing on the Advocare reps (who, 9.9 out of 10, only about 1% even know this article even exists). Ask any top leader in the MLM industry such as Ray Higdon, Eric Worrie, Simon Chan, Holton Biggs, etc. Acting like a vulture circling around a wounded rep who’s company screwed them over is 100% the wrong thing to do! Industry leaders hate this with a passion because it is one of the main reasons why the MLM industry has had such a bad rap for many. It’s a creepy practice that turns off more people than who it encourages. MLM is network marketing, meaning reps/consultants should be networking with people, not pouncing on them to join their team without even knowing if they even want to leave their company.

          I hate seeing any consultant lose their income or business, regardless of what company they are in. I don’t believe in trying to steal consultants away from other companies or downlines. All that does is create a toxic community culture within the company and team. I’ve been changing how I run my MLM business after listening to Simon Chan’s MLM Nation, Ray Higdon’s, and Eric Worre’s podcasts on iTunes (also on Stitcher for those who use an Android device) and have seen a big difference! Heck, I’ve been getting more sales and new consultant signups just from having conversations with people about animals and music. Nothing like getting a $100 order that resulted from a conversation about how much compassion a mouse can have and how they will help a cage mate raise their babies. I’ve gotten orders from posting recipes made with products my company sells, same with posting tips and helpful hints. I avoid posting my company link on posts and tweets. I get so much more interaction and interests doing things this way compared to pouncing on people to join my company or buy my products.

  10. I am so sorry for your losses and sorry for the black mark this puts on all MLM’s. You all must be devastated. I have been very successful with an MLM company for 50 years now and can attest to the fact that, like with any profession, there are some companies with integrity and some without. I am a professor and love the opportunity of working with good products in conjunction with my academic field. I hope those in Advocare who were successful in MLM and want to continue to do so, do some Due Diligence and find one of these good long-standing reputable companies. They are there.

    1. Jerry D is correct that when you work in NM that you are subject to decisions of the corporation’s leadership. That is why you research them and know their true exit strategy before jumping in bed. That is also true when working for bricks and mortar…perhaps even moreso. I seriously question his suggestion that starting your own company as being protected any better… I have done all three. There is always a risk vs reward.

  14. I’m so sorry for the Advocare distributors. This is a huge blow. Don’t give up on the network marketing industry there are good companies out there that are vigilant in making sure their company is compliant. This is one of the best industries to be in. I have been in 4 companies and found one I can be proud of and my downline and I can all be successful in. Do you research in finding a company that has a great comp plan that pays at least 50% to it’s distributors, no compromise products, has a team spirit with a feeling of community, has at least been in business for 7 years (no start ups), is still in momentum, and has integrity. I found it and you can too.

Kevin, this is indeed an unexpected and difficult blow to many thousands of AdvoCare reps, and I agree that the way AdvoCare made the announcement was insensitive toward its reps and poorly considered. But there’s far too little hard information available yet, so you should not be tossing speculative conspiracy theories around. In fact, the FTC does conduct confidential negotiations and settlements; I have handled several over the years.

    1. Read the statement again. I’m aware that the FTC can initiate confidential investigations. It’s not their typical modus operandi. AdvoCare’s decision to completely fold without taking their chances is akin to the captain saving his or her skin first before the boat sinks. The lack of effort is appalling. They were in an enviable position compared to the vice grip the FTC had on Vemma, FHTM and just about every other pyramid scheme case they’ve initiated. AdvoCare had the benefit of time to prepare and they still folded. It’s pitiful.

We’ve been in four companies until we found the right one and are very successful. Here’s what you need to look for: first, and foremost, a company with high integrity; a company that’s been around at least seven years (no start ups); a comp plan that pays at least 50%; no compromise products and products that are unique; a community where everyone helps each other; leadership with vision and experience in this industry.     1. Its a sad subject that we have to speak on, that so many people are going to put in a position of having to work multiple jobs because of this dramatic change. All the people who were working for this company and are now having to find other ways to support their family. They all worked so hard to get where they are at and now in a blink of an eye it is all gone. I guess we never thought about how it would effect everyone in the long run. I guess all we did was sit back and think about ourselves and not who helped build your company. It would not surprise me,(given what happened to Mannatech years ago) if the FTC issued some kind of threat to Advocare, on the other hand, given my experience in MLM over the last 40 years, it would also not surprise me if the company just decided to screw it’s associates and close down for whatever reason.

Don’t give up -just do your research and find a company with high integrity, been around at least 7 years ( 17 years for company I’m with) this, a company plan that pays at least 50%, has no compromise products that are unique and scientifically proven beneficial, a supportive community helping each other and leadership with a vision and experience in this industry.   22. When I first read the FTC was involved I agree something was off and a red flag of concern was raised that ALL network marketers should pay attention to. What crossed my mind initially as a possible issue was actually mentioned in this article and has to do with the recruiting and how they were paid.
    What are the chances someone got mad about others cheating their system for the bonuses and being recognized as “Leaders to Follow” while those building organically struggled.
    Now for those who may not follow what I’m talking about let me make it very clear. If the Policy says you must be 18 yrs old it means your “dog” can not have an account with a pre-paid credit card. It also means you can not cheat the system to get the bonuses by creating “Dummy” accounts.
    IF it was a Whistleblower who brought it to the attention of the FTC good for them. My only comments are I hope they went to the company compliance department first for a possible resolution. The second thing is I don’t think everyone should be punished for the wrong doings of a select group of individuals if it was in fact the case. For the Reps who went all in I’m sorry this has happened to you.
    I walked away from one company due to deception and promised myself I’d never let another person’s actions or inactions take an opportunity in this industry away from me ever again.
    Finally, if you’re promoting a health product… Don’t make claims or use disease names or you’ll have the FDA involved too.
    Just do it RIGHT for ALL of us.

  27. Wow this must be awful for people who have put their heart, soul and trust into a company which by all accounts led their distributors to believe all was well and moving forward. After 22 years with the same MLM company I sure can sympathize with what some if not all Advocare people are going through. Many on here are offering up their deal as the next safest sure bet to move along and earn income etc. My company has been successful for over 21 years , many of those spent doing tons of “real” science based research on our flagship product(s) two main ones. I’m not going to make promises here where people are surely jaded and hurt. What I will point to is that we have a product and I can say this with full honesty and knowledge which has to be and will be marketed via MLM as it would never sell off a shelf anywhere. It requires distributors who understand the basic premise underlying how the product works and what it does for people and their health. I really get tired of both health companies in traditional business and MLM companies who make many health claims and of course say they have “real science” when in fact they have nothing any true medical scientist or doctor (MD’s) would sanction. If anyone out their from Advocare or any other MLM company would like to be part of a growing yet very solid well run company with a product that is backed by over 54 double-blind studies published in respected medical journals, over 44 Method of Use Patents for example method of use in the treatment of…….many different immune related diseases, Health Canada & FDA recognition (which is positive) listed in the USA & Canadian MD’s drug guides, used in USA veterans’ hospitals, and given GRAS recognition by the FDA (Generally Recognized As Safe) and has been used over the last 22 years by thousands of people for preventative purposes and many. many ill people who’ve been very positive impacted using these two products. Of course we also have a line of other add on natural health products which help open doors for distributors, all of which are North American and of the utmost high quality.   28. As a distributor for AdvoCare, I can tell you that AdvoCare is an amazing company. A company that has never led anyone wrong. I’ve been with AdvoCare since 2004, and it’s an enormous family of integrity.

    You can never believe any type of media coverage. Just go to the source if you’re looking for answers. I personally wouldn’t take information at face value, especially if the source has never been a part of AdvoCare.

    There are many company’s that will never be able to have something north of 60% of revenue coming from real customers that have no connection to the compensation plan and Rep’s who have 10 or more real customers. Companies that don’t manufacturer their own product and pay another manufacturer to produce it, end up with products that priced to high to keep long term customers. So they end up as self consumption models where the Rep’s are buying most of the products. The FTC is coming down on this type of company.

Well 18 years ago my wife approached me about a wellness company at the time we just wanted safer products in our home or I should say she wanted safer products in our home… my mind went right to Amway or that kind of model… even though we were not looking for an income I told her no. Did not really put much thought into my no.. just said no. Luckily she did not listen to me on where we should shop as she never asked my permission before, why should I have a say now! She decided to try building a business, again I said it would not work and she replaced both of our six figure incomes and for the last 18 years we have been helping people side by side.. have not lost any money, hurt anyone or lost anyone else’s money. I am not going to try and figure out some clever way to get you to hear about the company I work with… I will say this,.. never did I imagine I would work from home, remember I said NO! Advocare did more than eliminate it’s MLM structure….it left thousandsof distributers stranded wondering how to pay their bills. My heartfelt sympathy to those affected by this move.   37. All very sorry to hear about this shift. 100k people out of work for any reason is a tragedy. The right to earn and provide is one of the most basic we have. I want to tell you that there are opportunities out there. Our company is a startup, and in the Telecommunications/Ride-share business. If you need a position we are open. The company is Vibe Direct, the ride share is a service called Vibe Ride. To help I had to advertise a little.
