Direct selling is a definitive chapter in the story of American entrepreneurship, generating $34.7 billion in annual retail sales according to the Direct Selling Education Foundation. Yet, most independent sellers do not realize that the flexible business model they chose is currently being debated by lawmakers and regulators in Washington, D.C. and state capitals nationwide.
The real challenge is that many of the laws affecting independent work were written long before people could build businesses through social media, video calls and online storefronts. Today, these outdated rules are creating ambiguity, inviting litigation and causing a structural shift where the legal boundary between employment and independent work is being actively rewritten.
These conversations will be better informed if policymakers hear directly from the people who live this work every single day. Many regulators still operate under the flawed assumption that independent sellers do not fully comprehend what employee reclassification would mean for their livelihoods. That assumption can only be corrected when they hear the real, unvarnished stories.
